RACING Victoria is appealing the decision against the Victorian Civil and Administrative Tribunal (VCAT) decision in March to clear trainers Danny O’Brien and Mark Kavanagh of cobalt offences.

This step will take the plaintiffs to the Supreme Court of Victoria greatly increasing the financial burden of representation to both parties, let alone the outcome.

The VCAT ruling found fault with the testing procedures for cobalt and laid the blame squarely with the veterinarian Dr Tom Brennen who was disqualified for five years.

Racing Victoria is challenging the ruling on the testing procedures and also seeking to establish a level of responsibility that should rest with the trainers in regards the administration of the ‘vitamin complex’ that contained excessive amounts of cobalt.
