Kilbeggan ‘winner’ will be reinstated

OWNERS Andrew and Gemma Brown have been successful in their appeal against the demotion of Mylestown Upper from first place in a Kilbeggan maiden hurdle on April 22nd.

Many observers felt the decision by the acting stewards on the day to award the race to Hymie Weiss was harsh as the contact was marginal and the demotion was not consistent with other races where similar contact had occurred.

In arriving at their decision to reinstate Jamie Codd’s mount as the winner, the Appeals Body (Peter Law, Roddy Ryan and John Tyrrell) said they “could not be satisfied on the balance of probabilities that the winner had improved its position as a result of any interference.”

Heffernan wins appeal case

SEAMIE Heffernan has won his appeal against a six-day whip ban he picked up at Cork on April 23rd for his winning ride on Kyprios, who runs again today in the Lingfield Derby Trial. Heffernan told the Appeals Body (Frank Clarke, Stephen Collins and Philip Caffrey) that his mount hung both ways and cocked its jaw, forcing him to use his whip “on two or three occasions” for corrective purposes.

The Appeals Body was satisfied that some of Heffernan’s use of the whip was for corrective purposes “and that the remaining number of strikes did not result in a breach” of the regulations.
